1. Acceptance of Terms

By creating an account or using zSellify, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use our services.

2. Description of Service

zSellify is a video presence infrastructure platform that:

• Crawls and analyzes your website content
• Generates short-form video content using AI
• Publishes videos to connected social media platforms (YouTube, TikTok, Bluesky, etc.)
• Provides analytics and management tools

3. Account Registration

To use zSellify, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

4. Subscription and Payments

Pricing: Our service is offered through various subscription plans. Current pricing is available on our website.

Billing: Subscriptions are billed monthly or annually in advance. Payments are processed securely through Stripe.

Cancellation: You may cancel your subscription at any time. Access continues until the end of your current billing period.

Refunds: We offer refunds on a case-by-case basis. Contact support within 7 days of purchase for refund requests.

5. Acceptable Use

You agree NOT to use zSellify to:

• Create content that violates any laws or regulations
• Infringe on intellectual property rights of others
• Generate misleading, deceptive, or fraudulent content
• Create content that is hateful, harassing, or discriminatory
• Distribute malware or engage in phishing
• Violate the terms of connected social media platforms

6. Content Ownership

Your Content: You retain ownership of your original website content and any content you provide to zSellify.

Generated Videos: Videos generated by zSellify from your content are owned by you. You grant us a license to process and distribute this content on your behalf.

Our Platform: zSellify and its underlying technology remain our property.

7. Third-Party Platforms

When you connect social media accounts (YouTube, TikTok, Bluesky, etc.), you must comply with their respective terms of service. We are not responsible for actions taken by these platforms, including content removal or account suspension.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We are not liable for any losses due to service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, zSellify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless zSellify, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these Terms.

11. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the service ceases immediately. We may delete your data 30 days after termination.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
